Terms of Service

These terms are an agreement between [Vendor legal name] ("we") and the company that signs up ("you") for our hiring, onboarding and exit platform. Last updated: [date].

The service

• We provide the platform as a subscription, as described on the plan you choose.
• You may use it for your own recruitment, onboarding and employee exit processes, and (if you are a staffing agency) for placing candidates with your clients.
• You are responsible for your users, for the accuracy of what you enter, and for following the employment, privacy and anti-discrimination laws that apply to you. The platform does not give legal advice and does not decide who to hire.

Your data

• You own the data you and your candidates put into the platform ("Customer Data"). We use it only to provide and secure the service, and as described in our Privacy Policy and any data processing agreement we sign with you.
• You are the controller of Customer Data (the party that decides how it is used) and we are your processor (the party that handles it on your behalf). [Attach a data processing agreement.]
• You can ask us for an export of your data at any time. After your subscription ends we keep your data for [30] days so you can return or export it, then we delete it, except where the law requires us to keep it.

Fees and payment

• Fees are shown at checkout and are charged in advance through our payment provider. Plans renew until cancelled.
• You can cancel at any time from the billing page; access continues to the end of the paid period. [Refund terms.]
• If a payment fails we will retry and tell you; if it cannot be collected we may end access after notice. Free trials end automatically and need no card.

Acceptable use

• Do not misuse the service, probe or attack it, upload malicious files, or use it to unlawfully discriminate or to harass anyone.
• You must obtain any consent from candidates and employees that the law requires and publish your own privacy policy to them.

Availability and support

We aim for high availability but do not guarantee uninterrupted service. [Support hours and response targets.] Planned maintenance will be announced where practical.

Security

We protect the service as described in our security documentation. You must keep credentials secret, use two-factor sign-in for staff, and tell us promptly about suspected misuse.

Liability

To the extent the law allows, our total liability is limited to the fees you paid in the [12] months before the claim, and we are not liable for indirect or consequential losses. Nothing limits liability that cannot be limited by law. [Counsel to settle this section.]

Ending the agreement

Either of us may end the agreement for serious breach that is not fixed within [30] days. We may suspend access immediately to protect the service or other people.
